Espressif Systems (Shanghai) Co., Ltd. (hereinafter referred to as “Espressif” or “we”), as the developer and operator of [ESP32-S31 Developer Hub] (hereinafter referred to as the “Website”), attaches importance to the protection of users’ personal information. Accordingly, Espressif has formulated this “[ESP32-S31 Developer Hub] Privacy Policy” (hereinafter referred to as the “Policy”) and reminds users to carefully read and correctly understand this Policy before accessing or using the Website and services, and then make appropriate choices based on reasonable judgment.

This Policy applies to the Website and services. If you have any questions regarding this Policy, you may contact Espressif for consultation according to the methods specified in this Policy. If you do not agree with any provision of this Policy, you shall immediately stop using the Website and services. If you are a minor, please carefully read and fully understand this Policy under the accompaniment of your parents or other guardians, and use the Website and services after obtaining their consent. Once you use the Website and services, it means that you acknowledge and accept all contents of this Policy (including updated versions), and agree that Espressif may collect, use, process, transmit, store, and share your relevant information in accordance with this Policy and applicable laws.

1. Information That Espressif May Collect

In order to better provide you with the Website and services, and on the premise of safeguarding the security of user accounts and related lawful rights and interests, Espressif may collect the following information from users:

1.1 Personal Information Collected Through Registration or Login via Third-Party Accounts

To facilitate your quick and secure registration and login to the Website, we support third-party account login through GitHub accounts. When you choose and authorize the use of third-party account login, we may obtain the following information from the third-party platform, including but not limited to:

  • User login method
  • User ID and/or Username provided by the third-party platform
  • User email address linked to the third-party account (if any)

1.2 Website Account and Identity Information

After you complete registration or login through a third-party account, we may generate and maintain the following information related to your platform account:

  • Unique Website User Identifier (User ID);
  • Account binding status and login method records.

1.3 Log Information

Refers to certain information that may be automatically collected by the system through cookies or other similar methods and stored in corresponding login logs when you use the Website and/or services.

1.4 Information You Publicly Display

When you upload user-generated content (“User Content”, including but not limited to code, images, documents, comments, or other content) for information exchange, comments, or other interactions, such User Content will be displayed to other users according to the Website’s functional rules. Please publish information involving personal information, trade secrets, or other sensitive content with caution.

1.5 Other Information Generated During the Use of the Website

When you use the Website and/or services (including but not limited to accessing, downloading, uploading User Content, commenting, liking, etc.), we may collect information such as your login records and access times. Based on the continuous improvement of Website functions in the future, we may further collect and use your other data for statistics regarding user usage and subsequent optimization. If such information may, under specific circumstances, be regarded as identifiable personal information, we will strictly collect, use, and protect such information in accordance with applicable laws and regulations, and obtain your consent where necessary.

Note: For sensitive information prescribed by law and information not disclosed in the foregoing statement, we will inform you of the scope, purpose, and method of information collection through page prompts, pop-ups, or other means in order to obtain your consent. Meanwhile, obtaining authorization from users for a certain item does not necessarily mean that we will collect user information under such authorization; and even if we have obtained authorization from users for user information, we will only use such information within the necessary scope.

2 Purposes and Rules for the Use of Information Collected by Espressif

2.1 Espressif May Use the Collected Information for the Following Purposes

  • To provide, maintain, and optimize the Website and/or services;
  • For identity verification, account management, and login authentication;
  • To support interactive functions such as User Content display, likes, and comments;
  • To provide technical material downloads and related services;
  • To ensure Website operation, security protection, risk identification, and anomaly detection;
  • To fulfill legal and regulatory requirements or respond to regulatory requirements;
  • To handle complaints, disputes, infringement notices, or user feedback;
  • For other reasonable purposes related to the Website and/or services.

2.2 Rules for the Use of Your Personal Information

2.2.1 Espressif will use the collected information in accordance with this Policy and for the realization of the functions of Espressif’s products and/or services. After collecting your information, Espressif will take reasonable and necessary measures to protect your information under the current technological level.

2.2.2 Please note that the personal information you provide when using this Website and/or the services will continue to be authorized for our use unless you withdraw your consent by deleting such information or explicitly objecting to Espressif’s collection of it by contacting us or through other means. After you withdraw your consent, Espressif will stop using and delete your personal information, or anonymize your personal information, or where it is technically difficult to delete or anonymize such information, stop all processing except storage and necessary security protection measures, unless otherwise provided by applicable laws and regulations.

2.2.3 Generally, Espressif will retain your personal information for the shortest period necessary to achieve the purposes described in this Policy during your use of the products and/or services, unless otherwise required by applicable laws.

2.2.4 Where Espressif intends to use your personal information for purposes not specified in this Policy, or use information collected for a specific purpose for other purposes, Espressif will obtain your consent through explicit authorization, which will be reflected through announcements, agreements, or similar methods.

3 Sharing, Transfer, and Disclosure of Information

3.1 Sharing of Information

3.1.1 Under non-essential circumstances, Espressif will not proactively share your information with any companies, organizations, or individuals outside of Espressif, except in the following circumstances:

  • With your prior explicit consent or authorization;
  • Where required under applicable laws and regulations or by administrative, judicial, or other competent authorities;
  • Within the scope permitted by laws and regulations, where necessary to respond to public emergencies or in urgent situations, where it is necessary to protect the personal safety and property interests of Espressif, you, other Espressif users, or to prevent harm to the public interest, property, or safety;
  • Where sharing your information is necessary to realize the basic functions of the Website services or provide services requested by you;
  • To handle disputes or controversies between you and others upon your request;
  • As provided in relevant agreements signed with you (including electronically signed agreements and corresponding platform rules) or other legal documents;
  • For academic research purposes, subject to appropriate protective measures;
  • For use in compliance with laws and regulations and public interests, subject to necessary technical and management measures.

3.1.2 Espressif may share your personal information with its affiliates. However, Espressif will only share necessary personal information within the necessary scope, and such sharing shall be subject to this Policy. If affiliates intend to change the purposes or methods of processing personal information, they shall again obtain your authorization and consent.

3.1.3 Espressif may share your information with partners and other third parties to ensure the smooth completion of services provided to you. However, Espressif will only share your personal information for lawful, proper, necessary, specific, and explicit purposes, and only to the extent necessary for service provision. Espressif’s partners shall not use the shared personal information for any other purposes.

3.1.4 Espressif may exchange information with other companies, organizations, and individuals only for the purpose of complying with laws and regulations, implementing or applying this Policy and agreements related to the use of the Website, or protecting the lawful rights and interests such as personal information security and property security of Espressif, you, or other Espressif users.

3.1.5 Before providing your information to the above third parties, Espressif will inform you of the name, contact information, processing purposes, processing methods, and types of personal information of such third parties, and obtain your separate consent.

3.1.6 For companies, organizations, and individuals with whom Espressif shares personal information, Espressif will require them to comply with confidentiality obligations and process personal information securely in accordance with Espressif’s instructions, this Policy, and any other relevant confidentiality agreements.

3.2 Transfer of Information

Under non-essential circumstances, Espressif will not transfer your personal information to any company, organization, or individual, except in the following circumstances:

3.2.1 With your prior explicit consent or authorization;

3.2.2 Where required under applicable laws and regulations or by administrative, judicial, or other competent authorities;

3.2.3 As provided in relevant agreements signed with you (including previously signed electronic agreements and corresponding platform rules) or other legal documents;

3.2.4 Where relevant transactions involve the transfer of personal information, Espressif will inform you of the name and contact information of the recipient and require the company or organization succeeding to your personal information to continue to be bound by this Policy. If the recipient changes the original purposes or methods of processing personal information, Espressif will require such company or organization to obtain your consent or authorization again.

3.3 Disclosure of Information

Espressif will publicly disclose your personal information only under the following circumstances where security protection measures in line with industry standards have been adopted:

3.3.1 Where you consent to or authorize Espressif to disclose it;

3.3.2 Where you actively disclose relevant information to the unspecified public through the use of Website functions, such disclosure being made by yourself, and Espressif only provides corresponding technical services according to your instructions;

3.3.3 Where laws and regulations or administrative, judicial, or other competent authorities require the provision of your personal information, Espressif may disclose your personal information according to the required types and methods of disclosure. Subject to compliance with laws and regulations, when Espressif receives such disclosure requests, Espressif will require corresponding legal documents and carefully review all requests to ensure they have lawful basis, and will only provide data limited to the specific investigation purposes of the competent authorities;

3.3.4 Under express legal authorization, where necessary in emergencies to protect the lawful rights and interests or public safety and interests of you, Espressif, and other users;

3.3.5 Subject to explicit provisions of laws and regulations and the agreements under user agreements or other similar agreements relating to Espressif’s products and services.

4 Information Security Protection

4.1 Data Security Technical Measures:

Espressif will adopt security protection measures in line with industry standards, including establishing reasonable institutional norms to prevent unauthorized access, use, or modification of your personal information and avoid data damage or loss. Espressif will use security technologies and procedures to detect and record network operation status and cybersecurity incidents and take necessary technical measures to ensure network security and prevent information loss, improper use, unauthorized viewing, or disclosure. For example, in certain services, Espressif will use encryption technologies to protect the personal information you provide. However, please understand that due to technological limitations and various possible malicious means, it is impossible to guarantee 100% security of information in the Internet environment despite our best efforts to strengthen security measures. You should understand that the systems and communication networks used to access the Espressif platform and/or services may encounter issues due to factors beyond Espressif’s control.

4.2 Espressif only permits employees and partners who need to know relevant user information to access users’ personal information and has established strict access control and monitoring mechanisms for this purpose. Espressif also requires all personnel who may have access to your personal information to fulfill corresponding confidentiality obligations.

4.3 The Internet is not an absolutely secure environment. Communication methods with other users such as emails, instant messaging, and social software cannot guarantee complete encryption. Espressif recommends that you use complex passwords when using such tools and pay attention to the protection of your personal information security.

4.4 Security Incident Handling: To address risks that may arise from personal information leakage, damage, or loss, Espressif will activate security plans for different security incidents, promptly take loss prevention measures, conduct analysis, formulate remedial measures, and actively cooperate with relevant responsible departments for tracing and combating such incidents. At the same time, Espressif will inform you in a timely manner, in accordance with legal and regulatory requirements, of the basic circumstances and possible impacts of security incidents, measures already taken or to be taken by Espressif, suggestions for your independent prevention and risk reduction, and remedial measures for you. Espressif will also inform you of the relevant circumstances of incidents through email, letters, telephone, push notifications, or other methods. If it is difficult to notify all personal information subjects individually, Espressif will issue announcements through reasonable and effective means. Meanwhile, Espressif will also proactively report the handling of personal information security incidents to regulatory authorities as required.

5 User Management of Personal Information

5.1 You have the right to access, review, copy, transfer, supplement, modify, and delete your personal information; however, modification or deletion of relevant information may affect your use of the Website and/or services or the realization of certain functions.

5.2 You have the right to change or withdraw your authorization: you may change the scope of authorization for Espressif to continue collecting personal information or withdraw your authorization by unbinding third-party account login, canceling your account, or contacting us through other channels. Please understand that if a certain platform function requires specific personal information to be realized, after you withdraw your consent or authorization, Espressif will no longer be able to provide the corresponding services and/or functions, nor process the corresponding personal information. However, your decision to change/withdraw consent/authorization will not affect the personal information processing previously carried out based on your authorization.

5.3 Subject to satisfaction of relevant agreed conditions, you may directly apply to cancel the relevant account. For the data processing rules after account cancellation, please refer to Section 2.2.2 of this Policy.

5.4 Espressif will adopt appropriate technical means to ensure that you may inquire, supplement, modify, or delete your personal information, or contact us through other channels to apply for supplementation, modification, or deletion of relevant information. Upon receipt of your application, Espressif will process it according to procedures (for example, Espressif may require you to provide relevant proof to verify your identity).

6 Protection of Minors’ Information

6.1 Espressif attaches great importance to the protection of minors’ personal information and will protect relevant information of minors in accordance with relevant national laws and regulations.

6.2 With respect to circumstances where minors’ information is collected with guardian consent for the use of Espressif’s products or services, Espressif will only use, share, transfer, or disclose such information where necessary under this Privacy Policy.

6.3 If Espressif discovers that it has collected minors’ personal information without prior verifiable guardian consent, Espressif will delete such information as soon as possible after verification.

6.4 Guardians shall bear the primary responsibility for protecting minors’ privacy rights in the online environment.

7 Disclaimer

In addition to the disclaimer circumstances already specified in this Policy, Espressif shall also bear no responsibility under the following circumstances:

7.1 Any leakage, loss, theft, misuse, or tampering of personal data caused by your disclosure of user passwords to others, sharing of registered accounts with others, or other improper personal safekeeping;

7.2 Any leakage, loss, theft, misuse, or tampering of personal data caused by force majeure affecting normal network operation, including temporary shutdowns due to hacker attacks, computer virus intrusion, government control, or other causes;

7.3 The Website may contain functions linking to third-party platforms. Such third-party platforms are independently operated by third-party entities, and their information processing activities shall be governed by the rules of such third-party platforms;

7.4 Any leakage of personal information and any legal disputes and consequences arising therefrom caused by reasons not attributable to the Website.

8 Scope of Application of This Policy

8.1 All services provided by the Website shall be subject to this Policy. Specific privacy policies (if any) for certain products and/or services shall be separately specified in the user agreements or separate privacy policies for the relevant products and/or services. Such privacy terms for specific products and/or services constitute part of this Policy. In the event of inconsistency between the privacy terms of relevant specific products and/or services and this Policy, the privacy terms of such specific products and/or services shall prevail.

8.2 This Policy only applies to information collected by Espressif through the Website and does not apply to any products and/or services provided by third parties or third-party information usage rules. For example, information collected by third-party products and/or services (including any third-party platforms) accepted through the Website services shall not be subject to this Policy, and Espressif shall not bear any responsibility for any use of such information by third parties.

9 Amendments and Notices of This Policy

In order to continuously improve the functions and user experience of the Website, Espressif may revise the terms of this Policy from time to time. The revised Policy will be promptly notified and displayed to you by appropriate means including but not limited to push notifications and pop-ups, so that you may stay informed in a timely manner. If you continue to use the Website services, it means that you agree to be bound by the revised Privacy Policy. In the event of material amendments to this Policy (such as new purposes, scope, or methods of information collection), the Website will notify you in a prominent manner and obtain your explicit consent where necessary.
